Terms and conditions of supply

These terms and conditions apply only if you are making purchases from us as a consumer; i.e. for purposes outside of your business, craft or profession, and you intend to use our accessories for your own personal use and agree not to resell. If you have a trade account, please request our trade account terms and conditions from sales@evotech-performance.com

Please read the following important terms and conditions before you buy anything on our website and check that they contain everything you want and nothing that you are not willing to agree to.

  • The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that up to 14 days after receiving your goods, in most cases, you can change your mind and get a full refund.
  • The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product you’re entitled to the following:
    • up to 30 days: if your goods are faulty, you can get a refund; and
    • up to six months: if it can’t be repaired or replaced, then you’re entitled to a full refund in most cases.

These terms and conditions set out:

  • your legal rights and responsibilities;
  • our legal rights and responsibilities; and
  • certain key information required by law.

In these terms and conditions:

  • ‘we’, ‘us’ or ‘our’ means Drury Precision Engineering Ltd trading as Evotech Performance; and
  • ‘you’ or ‘your’ means the person making a purchase from us.

Ordering with us

Making a purchase from Evotech Performance couldn’t be easier. Simply browse our store and add the items you want to buy into the shopping cart. After you’ve finished shopping, click on 'Checkout' and you will be asked for a few details so we can complete your order.

We accept the following payment types at checkout: Visa, Visa Debit, Visa Electron, Mastercard, Maestro UK, Solo, PayPal Express & Bank Transfer (available to trade customers only). Unfortunately, we are unable to accept Western Union transactions and will never request a Western Union payment from you.

We’re also pleased to offer our UK customers 'Pay Later' and 'Pay in 3' payment options via Klarna. Please click here to find out more about Klarna or read the full terms and conditions or FAQs here.

Alternatively, you can make payment or place your order over the telephone. With all credit and debit card payments, we process your order straight away through the fully secure system Mollie and PayPal processing services and Worldpay (for phone orders). Some trade orders can also be made by BACs (subject to status). When the order is placed via our website, credit card numbers are encrypted using 128-bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any website.

For orders made from the UK, all prices include VAT. Customers ordering Evotech accessories from outside of the UK are required to pay the relevant VAT on entry – this rate is different for each country. On all orders placed from outside of the UK, your credit card company will convert the transaction to your own currency once processed.

As soon as your order is placed or (for telephone orders) as soon as your order is placed on our system, you will receive an automated email confirming we have received your order. However, this email does not indicate that a contract exists between us. Once we have indicated acceptance of your order, we’ll send you an invoice. We have included this term to protect us in the event that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the new price is acceptable.

If you have made an error when ordering or have had a change of heart, you can amend or cancel your order by calling or emailing us before you receive notification of dispatch.

If your item is not in stock, you can register your email address or mobile phone number with us to be notified when new stock is available. Simply click the ‘message me when available’ tab within the product page and complete your details.

We will only accept your order when we email you to confirm this. At this point, a legally binding contract will be in place between you and us.

We guarantee your satisfaction. All of our products come with a 14-day no quibble guarantee.

Shipping & Delivery

We always try to minimise your delivery costs while getting your order to you as soon as possible and we offer a range of delivery options to suit your requirements. The following can be selected at checkout:

  • UK – DHL Domestic Express 24-48 hour service
  • Europe – DHL Express -5 Working Days
  • Europe – DHL Deutsche Post – 10-15 Days
  • Europe and rest of the world – UPS Express – 2-4 Days
  • Europe and rest of the world – UPS Express Saver – 5-8 Days
  • Rest of the world – DHL Deutsche Post – 8-20 Days

All customers can use their consignment number on their shipping confirmation to track their parcel through the relevant courier. Please note that this service varies depending on the chosen shipping option and the destination country. For international orders using the DHL Deutsche Post  delivery option, tracking outside of the UK is reliant on the equivalent service providers in the destination country and cannot be guaranteed. If you would like a delivery quotation or require special delivery methods, please email sales@evotech-performance.com and we will be pleased to assist.

Please also note that following the UK’s exit from the EU on 31 January 2021, we are aware of some additional charges, which are payable when your parcel reaches the destination country. These may include small disbursement fees or handling fees on orders. These additional charges are dependent on the destination country.  

Next day delivery

  • Monday to Friday orders placed before 12pm midday will ship the same day(excludes bank holidays)
  • Bank holidays and weekend orders will normally be shipped next working day.

You are responsible for the goods once they have been delivered to the address you specified when you placed the order with us. This means that the risk in the goods passes to you when you take, or a third party takes, possession of the goods at the delivery address.

Returns & Replacements

We’re confident that you’ll be happy with your Evotech Performance product. However, if you would like to return or replace a product that you purchased at www.evotech-performance.com please carefully read the following information and follow the instructions below before returning your item. Please note that if you purchased an Evotech Performance product via one of our dealers/stockists, you should contact them in the first instance. Evotech Performance will not be held liable for returns on purchases made via a third party.

These terms of return only apply to consumers. If you are a trade customer, please refer to our trade account terms and conditions.

Returns within 14 days

When you purchase a product from www.evotech-performance.com, you have the right to cancel your order at any time before your goods are dispatched or return them within 14 days after delivery for any reason or no reason whatsoever. This 14-day period begins on the day after you receive the goods.

When returning an item that you purchased directly from us, you will have to pay the return postage and will be liable for any damage to the product. We will only refund the return postage if we have sent the wrong product, the product is faulty, or for any other reason that is our fault. To return an item within the 14-day period, please follow the instructions and complete the form here.

Warranty periods

We’re proud of the excellent quality and durability of all our products and as a result are pleased to offer a 12-month warranty on all items. This warranty provides assurance that all Evotech products purchased from www.evotech-performance.com are fit for purpose and are free from defects in the materials.

The warranty does not cover product failures due to misuse, accident, incorrect fitting, alteration or repairs. Using the product off-road or in a situation that is considered non-standard also deems the warranty void.

If a product is faulty and a warranty claim is approved, we may ask for the product to be returned to us for testing. In this instance, we will always refund the return postage.

Our warranties begin on the day you receive your Evotech product, so if it develops a fault at any time within the first 12 months, please get in touch with our team directly at sales@evotech-performance.com. Please ensure you have proof of purchase, e.g. email order confirmation and/or receipt, as well as recent photography of the product, before attempting to make a claim.

Please note that if you purchased an Evotech Performance product via one of our dealers/stockists, you should contact them in the first instance to organise a return under warranty. Evotech Performance will not be held liable for returns on purchases made via a third party.

Other warranty considerations

Fitting instructions are available to download from the relevant product page on the website – please ensure that you follow the instructions correctly and get in touch with our Evotech Product Team at sales@evotech-performance.com if you need additional help. Customers are responsible for ensuring that fitting an Evotech product does not affect your motorcycle's warranty and you are advised to consult your insurance provider to update them on any modifications you make to your bike.

Other returns

It is always the customer’s responsibility to ensure that delivery address details are entered correctly at the time of order and that an appropriate delivery day and time is selected so that the courier can successfully deliver your product(s) to you. If an item cannot be delivered to the address specified on the order or is refused on delivery and is subsequently returned to us by the courier, you will be refunded for the cost of the item but will be liable for the delivery costs incurred.

Please note that it is also the customer’s responsibility to ensure that the relevant import duties for the destination country are paid at customs. If the item(s) are refused at customs they will be returned to us and the customer is liable for all associated delivery costs, including any return import duties. The customer is also liable for any damage to the product that has been sustained in transit. Please be aware that some countries operate a refuse and destroy policy and Evotech Performance accepts no liability if the customer’s items are disposed of in the above circumstances.

While we will always do our best to highlight any known shipping delays in advance, external factors beyond the control of your chosen courier may affect the delivery of your order. You can use the tracking information provided to follow the location of your package, but should you be concerned about a significant delay, or should your order not arrive when expected, please contact us at sales@evotech-performance.com with your Evotech Performance order number and consignment details. Once a customer notifies us of a shipping delay, we will contact the relevant courier to request more information and will provide the customer with an update as soon as possible. Should we confirm that the package is lost in transit, or it is not delivered within 60 days from the date of despatch, we will provide a full refund. Unfortunately, we are unable to provide a refund until we have confirmed the location of your order with the relevant courier.

In the unlikely event that we have to recall one of our accessories for any reason, we will contact you to let you know and send you a replacement, free of charge. If we need you to return the faulty product, we will also cover the relevant postage costs.

Limitation on our liability

Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any:

  • losses that were not foreseeable to you and us when the contract was formed;
  • losses that were not caused by any breach on our part;
  • business losses; or
  • losses to non-consumers.

Product photography

From time-to-time, we may make minor updates to our product designs in order to improve the aesthetic look, quality or performance of our accessories. For example, this could include changing the position, size or colour of the logos we print/emboss on our Evotech Radiator Guards. In this instance, all product photography used on our website should always be viewed for illustration purposes only and may not be exactly representative of the product you receive when purchasing from us. This is especially the case with some of our older product ranges. We always do our utmost to ensure all product photography on our website is as up-to-date as possible.

Leaving us feedback

Customer feedback is extremely important to us as it enables us to continually improve and develop our Evotech accessories. We use a third party review platform, Judge.me, to collect customer reviews from completed purchases. Judge.me reviews are incorporated into our website so that other buyers can read and review real feedback on the parts they have purchased directly from www.evotech-performance.com.

Once a purchase is completed, the customer will receive an email from Judge.me, asking them to leave an optional review. In the interest of fairness, all reviews whether positive or negative, will be uploaded to the website. However, Evotech Performance reserves the right to respond to reviews if the comment is deemed unfair or incorrect. This response will also be visible on the website. Occasionally, in the event of a serious issue or concern, Evotech Performance may contact the customer to discuss the feedback directly.

Law

The laws of England and Wales apply to this contract, although if you are resident elsewhere you will retain the benefit of any mandatory protections given to you by the laws of that country.

Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means that you can choose whether to bring a claim in the courts of England and Wales or in the courts of another part of the UK in which you live.
